Is Indigenous Peoples’ Day and Columbus Day a holiday for sale agreements?

A message from OREF Forms Counsel, Jeff Davis

Columbus Day has been a Federal holiday since 1971.  With the passing of HB 2526 Indigenous Peoples’ Day became an Oregon holiday.  Both Columbus Day and Indigenous Peoples’ day are celebrated on Monday, October 11, 2021.
Both the sale agreement and ORS 696 define business days as days other than Saturday, Sunday, Federal holidays, or Oregon holidays.  Therefore, Columbus Day and Indigenous Peoples’ Day is not a business day under the OREF sale agreements and should not be counted in time periods or used as a closing deadline.
