The Well and Septic Addenda Require More Than a Simple “No”
Keep in mind that the termination provisions included in OREF 082 – Private Well Addendum and OREF 081 – Septic/Onsite Sewage Addendum do not provide for unconditional disapproval. In both addenda, before they can terminate the transaction, the buyer must provide to the seller a list of “substantial deficiencies” discovered during the well or septic system inspection, allowing the opportunity to negotiate a solution.
All comments and responses from OREF or its staff, managers, and volunteers are non-legal opinions made for general purposes. Each Forms subscriber must rely solely upon their Principal broker or personal legal counsel for specific advice and instruction. You and your client should independently confirm that the Form(s) you use are legally suitable for the purposes intended and that they are current with respect to all laws and regulations.
