Verbal Promises Aren’t Enforceable: Put It in Writing!

Only the written terms in the Sale Agreement, including counteroffers and addenda, are legally enforceable. Verbal agreements aren’t binding and can lead to legal disputes. Remind clients not to make verbal promises without involving you in documenting them properly. Agents must avoid relying on emails, texts, or calls as these are not enforceable unless added to the Agreement and signed by both parties, and are a violation of OAR 863-015-0135(9), which was added in 2017.
