Lead-Based Paint Addendum
The language and compliance requirements contained in the Lead-Based Paint Disclosure Addendum are mandated by the EPA and are not tailored specifically to Oregon real estate practice.
The EPA recently revised both the required disclosure language and related compliance obligations. Under the updated provisions, reflected in Lines 17–19 of OREF 021 – Lead-Based Paint Addendum, a buyer’s agent receiving compensation from the seller must now: (1) inform the seller of the seller’s obligations under the federal lead-based paint law, and (2) acknowledge the buyer’s agent’s own obligations under the applicable regulations. These obligations are similar to those already imposed on the seller’s agent.
