Dear Forms Committee: If I have another agent working with a buyer for me while I’m on vacation, what forms do I need to use to ensure they are properly documented as representing the buyer during that time?
Your firm may have policies on how to handle this, so be sure to check with your Managing Principal Broker. However, an easy way to handle this would be to use the OREF 050A—Buyer Representation Agreement Addendum and identify the agent and time frame they will be assisting in your absence. If the buyer is already a party to a Sale Agreement, the law requires the buyer and seller to acknowledge the agency relationship of the temporary agent, so use OREF 010–Final Agency Acknowledgment Addendum to accomplish that.
All comments and responses from OREF or its staff, managers, and volunteers are non-legal opinions made for general purposes. Each Forms subscriber must rely solely upon their Principal broker or personal legal counsel for specific advice and instruction. You and your client should independently confirm that the Form(s) you use are legally suitable for the purposes intended and that they are current with respect to all laws and regulations.
