Dear Forms Committee: Last month, you suggested a list of forms we should include in our buyer representation packets. What about listing packets? Do you have a list of suggestions we should include for our seller presentations?

Here are the must-haves to include in your seller presentations:

  • OREF 047 – Advisory Regarding Real Estate Compensation
  • OREF 042 – Initial Agency Disclosure Pamphlet
  • OREF 040 – Disclosed Limited Agency Agreement for Sellers
  • OREF 043 – Advisory Regarding Electronic Funds
  • OREF 104 – Advisory to Buyers and Sellers Regarding Fair Housing
  • Listing contract provided by your MLS
  • Forms required by your firm

 

Additional items you may want to consider:

  • OREF 020 – Seller’s Property Disclosure Statement and other disclosures that may apply. This gives your seller an opportunity to review these forms ahead of time so they are prepared to fill them out and have them ready and available to a buyer.
  • OREF 000A —Things to Know Before You Sign and a sample sale agreement are available on our website. Take some time to review each section thoroughly to assist your seller in understanding the document. Make sure to include the Definitions & Miscellaneous sections to help familiarize them with the key terms used throughout the agreement. This will prepare your seller for what to expect once a buyer has submitted an offer.
  • A list of services you provide, including market analysis, listing preparation, marketing plan (including traditional and digital advertising), and how you negotiate on your seller’s behalf.
  • A list of helpful FAQs with a detailed breakdown of the transaction process, including reviewing offers, requests for buyer concessions, title review, negotiating repairs, the appraisal process, and steps toward closing.

All comments and responses from OREF or its staff, managers, and volunteers are non-legal opinions made for general purposes. Each Forms subscriber must rely solely upon their Principal broker or personal legal counsel for specific advice and instruction. You and your client should independently confirm that the Form(s) you use are legally suitable for the purposes intended and that they are current with respect to all laws and regulations.
