Do You Need a Buyer Representation Agreement With Your Spouse?

Q: I am licensed as a real estate agent in the State of Oregon. I am looking to buy property for myself personally, and my spouse will also be one of the buyers on the contract. Do I need to complete a Buyer Representation Agreement with my spouse?

A: Yes, there is no exemption for spouses in the Oregon administrative rules that require a written Buyer’s Representation Agreement before a licensee assists a buyer in the purchase of property. Therefore, the best and safest practice to avoid any licensing sanctions would be to enter into a signed Buyer Representation Agreement with your spouse.
