Dear Forms Committee: What is considered ‘Notice’ in the OREF Sale Agreement?
“Notice” is defined in the OREF Sale Agreement as a written statement delivered using the “Notification Method” described in the Miscellaneous section of the Sale Agreement.
The written statement can be in any form that complies with the chosen Notification Method – addendum, email, even text message – but the sender should always retain proof of proper delivery within the timeframes specified in the contract.
Certain “Notice” documents for specific scenarios are available in the OREF library. Those cases are always specified in the Sale Agreement.
All comments and responses from OREF or its staff, managers, and volunteers are non-legal opinions made for general purposes. Each Forms subscriber must rely solely upon their Principal broker or personal legal counsel for specific advice and instruction. You and your client should independently confirm that the Form(s) you use are legally suitable for the purposes intended and that they are current with respect to all laws and regulations.
