Dear Forms Committee: What tests must the seller perform when selling a property with a well?

Oregon law requires that the seller have the well tested for arsenic, nitrates, and total coliform bacteria upon accepting an offer. If the buyer would like additional tests performed (such as flow test, lead test, etc.), the buyer can indicate the additional tests that the buyer elects to have performed in Section 3 of OREF 082 – Private Well Addendum. Be sure to indicate who will pay for each additional test to avoid confusion during contract negotiations.

All comments and responses from OREF or its staff, managers, and volunteers are non-legal opinions made for general purposes. Each Forms subscriber must rely solely upon their Principal broker or personal legal counsel for specific advice and instruction. You and your client should independently confirm that the Form(s) you use are legally suitable for the purposes intended and that they are current with respect to all laws and regulations.
