Dear Forms Committee: If my buyer is writing an offer contingent on funds received from the sale of an existing property, what forms should be included?

If the buyer’s purchase of the property is contingent upon the buyer obtaining funds from the sale of an existing property, the buyer should identify that contingency in Section 4 of the Sale Agreement. The buyer should also include OREF 083 – Buyer’s Contingent Right to Purchase Addendum with their offer to document the terms of the contingency.

And keep in mind that the buyer will have to provide OREF 083A – Contingent Right to Purchase – Notice to Seller before the “Contingency Deadline” in the Addendum.

All comments and responses from OREF or its staff, managers, and volunteers are non-legal opinions made for general purposes. Each Forms subscriber must rely solely upon their Principal broker or personal legal counsel for specific advice and instruction. You and your client should independently confirm that the Form(s) you use are legally suitable for the purposes intended and that they are current with respect to all laws and regulations.
